Adult Disability Payment – Reconsiderations & Appeals

If you have been refused Adult Disability Payment (ADP) or are unhappy with the outcome of the award you receive, you may be able to appeal the decision. There are two stages to the appeal process:

  1. Redetermination

If you are unhappy with the decision about your ADP, you can ask for a redetermination. This means that Social Security Scotland will look at your case again. You can ask for a redetermination within 42 days (six weeks) of receiving the decision letter.

To ask for a redetermination, you need to fill in a form and send it to Social Security Scotland. You can find the form on the Social Security Scotland website.

If you are unable to fill in the form yourself, you can get help from a friend, family member, or support service such as Grapevine Disability Information for Edinburgh residents.

  1. Tribunal

If you are still unhappy with the decision reached after the redetermination, you can appeal to a tribunal. This is an independent body that will look at your case and make a decision.

You can appeal to a tribunal within 31 days of receiving the decision letter from Social Security Scotland.

To appeal to a tribunal, you need to fill in a form and send it to the tribunal. You can find the form on the tribunal’s website.

If you are unable to fill in the form yourself, you can get help from a friend, family member, or a support service.
